Session Booking Details

Payment: To secure the agreed-upon time and date exclusively for the client, a non-refundable retainer fee of $375.00 should be made to Carolyn Ruiz Creative. The remaining session fee must be settled 48 hours prior to the scheduled session. We accept Venmo or Zelle for retainers and session fees. Online print orders can be paid via Visa, Master Card, or American Express.

During your photo session: At Carolyn Ruiz Creative, we prioritize delivering exceptional photography services while maintaining our distinctive artistic style and reputation. As the photographer, we have full control over the nature, number, and style of the pictures we capture. To ensure a seamless experience, we kindly request that clients arrive dressed, made up, and prepared at the specified start time. Please note that sessions will promptly begin and end on schedule. While capturing the genuine personalities of your children, we kindly remind parents to be responsible for their cleanliness, hair, attire, and accessories.

Cancellation Policy: If a client requests to modify or cancel the agreement five or more calendar days before the session, the retainer fee will be applied to a reschedule date that is mutually agreed upon. However, if the client cancels the agreement four or fewer calendar days before the session or fails to attend, the session fee will be applied to one reschedule date that is mutually agreed upon within 6 months of the original shoot date. Failure to reschedule within this timeframe will result in forfeiture of the retainer.

For Rescheduling or Late Arrival: Should a client request to reschedule a session with a notice of at least 5 days prior to the scheduled event, the retainer fee will be applied to one rescheduled session within 6 months of the original shoot date. Failure to reschedule within this timeframe will result in the forfeiture of the retainer or session fee. Similarly, in the event of late arrival, the allocated session time will be reduced accordingly.

Session Termination: Carolyn Ruiz Creative reserves the right to terminate any session if the client fails to comply with the requirements stated in this agreement, if the model(s) are unwilling to be photographed, or if any participant engages in inappropriate behavior. The decision to offer reshoots will be at the sole discretion of the photographer.

Reserved Photographer: To ensure an exclusive and undisturbed session, only the individuals being photographed are permitted to attend. We kindly ask parents to cooperate with the photographer's instructions and refrain from interfering with their work. Please note that personal photography, video recording, audio capturing, and other recording devices are strictly prohibited during the session.

Travel Fee: For round trip travel exceeding 20 miles from San Clemente, CA, a travel fee of $3.50 per mile will apply.

Online Gallery: The session images will be showcased in a secure password-protected online gallery for viewing, sharing, downloading images and ordering prints. This online gallery will remain accessible for a period of two (2) weeks, starting from the time of electronic delivery to the client. We kindly request that digital file orders and prints be fulfilled within this timeframe, as they will be sent via email.

Copyright Information: Unauthorized copying or reproduction of session photographs captured by Carolyn Ruiz Creative is prohibited by law. Violators may be subjected to civil and criminal penalties as stipulated by Federal Law. All photographs, including potential proofs, are protected by copyright. Therefore, any form of reproduction, such as copying, re-printing, screen captures, or any other means of print reproduction, is strictly forbidden and constitutes a violation of copyright law. Carolyn Ruiz Creative reserves the right to utilize all negatives, proofs, photos, prints, and images for display and marketing purposes. By agreeing to these terms, the client hereby grants Carolyn Ruiz Creative a royalty-free, fully paid, and irrevocable license to utilize all aforementioned materials for commercial and artistic purposes while retaining ownership and copyright.

Liability: Carolyn Ruiz Creative shall not be held responsible or liable for any failure to provide services due to circumstances beyond our control, including acts of God, weather events, or government actions. Additionally, we cannot be held liable for equipment failure or the failure of software or other computer or electronic media that results in damage to proofs, negatives, prints, or photos, or renders them unable to be printed or duplicated.

Sales are Final: Due to the custom nature of each session, all sales are considered final.
